Registration

Otaku Punk may require registration to gain access to certain services such as making a purchase. If you choose to register, you agree to (a) provide accurate, current and complete information about yourself as prompted by the applicable registration form (b) not use the services for any purpose that is unlawful or prohibited by these terms or any other purpose not reasonably intended by Otaku Punk LLC.   4. To post or transit, or cause to be posted or transmitted, any communication designed or intended to obtain password, account, or private information from any user;
  5. To create or transmit unwanted ‘spam’ to any person or any URL

You acknowledge that, if any information provided by you is inaccurate in any way or you fail to abide by the terms set forth within the Terms and Conditions of Use we reserve the right to terminate your use of our site. 

User’s Age Limit & Access by Minors 

  • You must be at least eighteen (18) years old or under the supervision of a parent or legal guardian who agrees to be bound to the Terms and Conditions of Use. If you do not meet this requirement, you must not access or use the service.
  • You represent to us that (1) you are at least eighteen years old or (2) if you are a minor who is at least 13 years of age, you may only use the service under the consent and supervision of a parent or legal guardian who agrees to be bound by the Terms and Conditions of Use. We may request you to provide evidence of your parent or legal guardian’s consent of your use. We may also terminate your use of the service if it comes to our attention that any of your representations to us is not correct. Represented minors permitted to use any interactive service should be made aware of the potential risks to them. Parents and legal guardians shall be liable for the acts or omissions of their represented minors.
  • The Company neither intentionally nor unintentionally collects information from minors in cases where parents or legal guardians have not consented to the use of the service by a minor. However, if a parent or legal guardian identifies that a minor has provided us with personal information without the correspondent parent or legal guardian permission, the parents or legal guardians should contact the company. Upon the parent or legal guardians request, the company will delete any personal information of such minor without any further recourse from the parent or legal guardian. The parent or legal guardian will fully indemnify and release the company from any liabilities, damages, claims or any other legal actions in respect of the provision of the personal information of such minor to the company.

Termination

Your rights under this agreement will automatically be terminated if you fail to comply with any of the terms and conditions of this agreement. 

Intellectual Property 

The website and all of the content, features, and functionality (including but not limited to all information, logos, software, text, displays, images, video and audio, and the design, selection and arrangement thereof), are owned by Otaku Punk LLC and are protected by the United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. The entire compilation of the content found on this website is the exclusive property of Otaku Punk LLC. You may not reproduce, distribute, sell, license, copy, modify, publicly perform or display, transfer, transmit, publish, edit, adapt, prepare derivative work based on, or otherwise use any content except as expressly authorized by this agreement. 

Disclaimer of Liability

 You expressly understand and agree that to the fullest extent permissible by applicable law, in no event shall Otaku Punk LLC, or it’s future parent or affiliated companies, be liable to you for any personal injury, property damage, cost of substitute goods or services, loss of data, work stoppage, computer and/or device or technology failure or malfunction or for any form of direct or indirect, special, incident, consequential, exemplary or punitive damages based on any causes of action arising out of the use of the website or any alleged failure of performance, error, omission, interruption, deletion, defect, or delay in service, operation, or transmission of the websites, or any alleged computer virus, communication line failure, theft or destruction of property, and/or unauthorized access to, alteration of, or use of or posting of any record, content, or technology, pertaining to or on the websites. Otaku Punk shall implement and maintain reasonable procedures for protecting personal information in compliance with applicable law and the Otaku Punk Privacy Policy. 

Changes to these Terms and Condition of Use

Otaku Punk LLC reserves the right to revise these terms. In the event that revisions are made we will attempt to notify users of revisions via a service notification or an email associated with your account. By continuing to use the services after any revision, users agree to be bound by the revised terms. 

Governing Law

By accessing the website, you agree that the laws of the state of Colorado, without regard to principles of conflict of laws, will govern these terms of service, or any dispute or any sort that might come between Otaku Punk LLC and you, or it’s business partners and associates. 

Indemnification
